Clause 12 Exemptions
The power pursuant to clause 12.1 of the By-law subclauses 11.1 and 11.2 of this By-law do not apply to a moveable sign which;
advertises a garage sale taking place from residential premises; or
is a directional sign to an event run by a community organisation or charitable body.
The power pursuant to clause 12.2 of the By-law subclauses 11.1 and 11.2 of this By-law do not apply to a flat sign which only contains a newspaper headline and the name of a newspaper or magazine
The power pursuant to clause 12.3 of the By-law a requirement of this By-law will not apply where the Council has granted permission for the moveable sign to be displayed contrary to that requirement.
3 Delegates
Clause 11 Restrictions:
The power pursuant to clause 11.1 of the By-law the owner of a business must not cause or allow more than one moveable sign for each business premises to be displayed on the footpath area of a road at any time.
The power pursuant to clause 11.2 of the By-law a person must not cause or allow a moveable sign to be placed on a footpath area unless:
It only displays material which advertises a business being conducted on premises adjacent to the moveable sign or the goods and services available from that business; and
The business premises to which it relates is open to the public
The power pursuant to clause 11.3 of the By-law if in the opinion of the Council a footpath area is unsafe for a moveable sign to be displayed, the Council may prohibit or restrict the display of a moveable sign on such conditions as the Council thinks fit.
3 Delegates
Clause 10 Activities Requiring Permission: The power pursuant to clause 10 of the By-law a person may erect or display a banner on or over a road provided that the banner:
is not, without the Council's permission, attached to any building, structure, fence, vegetation or other item on a road that is owned by the Council;
is securely fastened to a pole, fence or other structure so that is does not hang loose or flap;
only advertises an event to which the public are invited;
is not displayed more than two weeks before and two days after the event that is advertises;
is not displayed for a continuous period of more than two weeks and two dates in any twelve month period; and
does not exceed 3m2 in size or 1.5m in height.
